Attorneys Title recently published and distributed its e-newsletter to over 1,200 contacts in North Carolina. This month's legal article, 'The Value of Insuring Your Client's Leasehold Estate', was written by Wilmington Title Counsel, Paul Lewis. - New Lien Affidavit Forms - updated May 2010

Most underwriters have recently created new lien affidavit forms and are requiring stricter compliance with lien waiver policies. The North Carolina Land Title Association (NCLTA) formed a committee to update its lien affidavit forms. The existing forms were created in 1993 and do not adequately address the current market conditions and are also in need of other clarification. The committee was comprised of a group of attorneys, some of whom work in the title industry and others who are real estate practitioners. A considerable amount of time was spent developing the content and the format of the forms. The committee decided to draft three separate forms rather than one all encompassing form. Attorneys Title has decided to adopt the NCLTA forms in lieu of our current forms. The forms below are the updated lien forms that were updated in May of 2010.
NCLTA Form 1 -Owner Affidavit and Indemnity Agreement (No Recent Improvements)
NCLTA Form 2-Owner/Contractor Affidavit, Waiver of Liens and Indemnity Agreement (Construction Recently Completed)
NCLTA Form 3-Owner/Contractor Affidavit, Indemnity and Subordination Agreement (Construction in Progress or Immediately Contemplated- Lender Coverage Only)
